Brian Merchant then joins, diving right into the misrepresentation of the Luddites in mass culture – largely expressing their aversion to technology as a problem of intelligence or conservatism, rather than their actual ideology, which objected to technology’s role in increasing (rather than decreasing) labor exploitation in industrializing England. Stepping back, Merchant then contextualizes the rise of Luddism in the 18th Century, walking through the particularly rapid mechanization of the textile and cloth industries, bolstered by increasing cotton production from the slave trade in North America, and the complete alignment of the Crown with the Capitalists’ decision to leverage technological development for themselves, and against labor, consumers, and community. Next, Merchant dives into the story of George Meller to paint a picture of the climax of the Luddite movement at the turn of the 19th Century, as, despite their best efforts, the 1800s see even more anti-labor automatization, pushing their tactics from disruption to destruction, only for violent pushback from the Crown and dwindling public support to eventually crush the movement. Wrapping up, Merchant explores the legacy of the Luddite movement, both as a foreshadowing of the role of the state in labor disputes, and in putting forward the blueprint for the militant unionism we see carried out by the most successful labor coalitions of today.

And in the Fun Half: Sam and Emma watch Netanyahu update the public on Israel’s ground operation in Gaza with an unsurprisingly genocidal allegory, and explore the diverse array of dehumanizing reactions to the conflict among Democratic figures – from Fetterman and Gottheimer to Jake Tapper. After expanding on the Western-led colonial structure of the establishment of Israel – particularly in the ethnic cleansing of local populations – Ilan Pappe walks through the thriving cosmopolitan world of pre-Israel Palestine, one in which communities and religions coexisted, as a proper pretext for a discussion of the following eviction and cleansing of these local populations in the leadup to the Nakba in 1948, also touching on the use of Europe’s own crimes against Jewish people as a justification for the violence being imposed upon the Palestinians from 1948 on. Wrapping up, Sam, Emma, and Professor Pappe explore the obvious failings of an Israeli two-state solution, why a single multi-racial, multi-ethnic democracy with full rights for Palestinians is the only viable option, and how Israel and Palestine are reading the international responses to the occupation.

Wrapping up, they look at the devastating impact of policing’s evolution alongside the automobile, and how it serves to reinforce the US police state. Emma concludes the free half by watching Fox & Friends begin to eat the moderate Republicans alive for refusing to endorse Jim Jordan’s speakership.

Sam is off today, but in honor of Indigenous People's Day he spoke with Peter D'Errico, professor emeritus of legal studies at the University of Massachusetts, Amherst,  about his recent book Federal Anti-Indian Law: The Legal Entrapment of Indigenous Peoples. But first, Emma spoke with Orly Noy, editor at Local Call and chair of B'Tselem's executive board, to discuss the recent fighting between Palestine and Israel.  Emma also walked through on the UAW’s labor action, Donald Trump’s assessment of RFK, a devastating earthquake in Afghanistan, and Gavin Newsom’s regressive veto campaign, before stepping back to look at the role of Israel’s ongoing apartheid state and Bibi Netanyahu’s genocidal government in pushing this conflict to its breaking point. Orly joins the show from Jerusalem, as she updates Emma on the state of war within Israel and Palestine, even as far from the primary conflict as Jerusalem is. Next, Noy parses through Bibi Netanyahu’s response as a perfect encapsulation of his political agenda, completely committing his power to punishing Gaza and Palestine, and shoring up his own political station. Expanding on this, Noy walks through the failure of the Israeli government to even provide safety for Israelis, dedicating their forces to a genocidal response and leaving civilian safety to civilian organizers, before she and Emma step back and assess the evolution of Netanyahu’s approach (or lack thereof) to Palestine, pulling every maneuver to bypass them politically, while maintaining a strict and severe military occupation. Wrapping up, Noy assesses Hamas’ outcast role in Palestinian politics and military resistance, and why ground invasion would be an incredibly dangerous development for the already criminally fragile open-air prison that is Gaza. Professor D’Errico then walks through the evolution of the doctrines of settler colonialism in what is now the United States, with the doctrine of Christian discovery that launched the colonial era from Spain and England setting the stage for the US’ own domestic justification for the “manifest destiny” agenda. Expanding on this, D’Errico and Sam explore the central cases in the establishment of Chief Justice John Marshall’s ‘Marshall Doctrine’ in Indian Law, which actively committed to the perspective of Christian dominion and discovery, and asserted the native peoples as a sub-human class unable to look after their land. Next, they look to the post-Marshall evolution of the doctrine, with the Court carrying its vision forward while slowly obscuring its origins, seeing it affirmatively cited even by supposedly progressive justices like RBH, without reference to Christianity. After expanding on the Marshall Doctrine’s secondary purpose as a reinforcement of federal domination over the states, D’Errico wraps up by walking through the contemporary battles over the Marshall Doctrine, the push for full assimilation of Native territories, and the need to bring the origins of the doctrine back into full public view.

Brian Concannon then tackles the recently approved, UN-backed, Kenyan-run mission to police the people of Haiti, walking through the birth of the mission in the U.S. State Department and their intense desire to not be seen killing Black Haitians in poor neighborhoods, resulting in their outsourcing of the project to the Kenyan military. Next, Concannon parses through the interests behind the State Department’s project to maintain the unelected regime of Ariel Henry – a project they present as pro-democracy – and their hope to avoid conflict before the 2024 election, before they wrap up with an assessment of the material impact of Biden’s anti-immigration presidency.

Next, they dive a little deeper into Trump’s response to his developing fraud case in New York, coming out of the gates targeting the “corrupt” judge and AG, despite the case NOT being a jury trial, before they shift to Matt Gaetz throwing away his future to embarrass Kevin McCarthy (to everyone’s benefit), and the strategic response from Democrats to let them fight. Then, they parse through Ben Collins’ recent reporting connecting Elon Musk’s Twitter agenda to a far-right, anti-Semitic, transphobic, and anti-vax article from a former Trump speechwriter that put forward Musk’s crippling of the public square as a central tool to the future far-right successes.

Happy Monday! Sam and Emma speak with Ian Millhiser, senior correspondent at Vox, to discuss the upcoming Supreme Court term. Then, they're joined by litigator Mark Bankston who has a special announcement! First, Sam and Emma run through updates on our 45-day reprieve from a government shutdown, the ongoing chaos among the House GOP despite that, Gov. Newsome’s disappointing unilateral action, Donald Trump’s fraud case, and labor action nationwide, before parsing through commentary on the House GOP’s absurd power struggle. Ian Millhiser then joins, diving right into this Supreme Court term’s primary challenges to the administrative state – namely Loper Bright Enterprises v. Raimondo – exploring the lasting governance of the Chevron Doctrine’s deference to government agencies, and the sudden emergence of the anti-democratic “Major Questions Doctrine” that the Court has been using to undermine any “major” decisions by government agencies (including student debt reform). After parsing through the evolution of these two doctrines (and the jurisprudence backing them up) and how Loper might see SCOTUS move onto the “Micromanaging Questions Doctrine,” Millhiser walks Sam and Emma through the radicalization of the US’ 5th Circuit over the Donald Trump administration, exploring how the GOP was able to blockade Obama’s appointments and confirm Trump’s en-masse. Wrapping up, Ian, Sam, and Emma tackle the far-right decisions coming out of the 5th Circuit, and what (if anything) the Supreme Court will do to keep their underlings in line. After Sam and Emma quickly parse through Jamaal Bowman’s ongoing Congressional debacle, they’re joined by Mark Bankston to discuss his representation of Ben Brody in a defamation case against Elon Musk, parsing through the issue at hand, what libel cases entail, and the vast damages that can come from the abuse of one’s public station.

And in the Fun Half: Sam and Emma tackle the madness surrounding the still-impending government shutdown, dive a little deeper into the unsurprisingly racist coverage of Jamaal Bowman… pulling a fire alarm, and assess Biden’s recent statement on the Civil Rights Act.
